What’s New?

Employment Law Potpourri

by Jennifer Shaw and Melissa Whitehead | | January 22, 2024

The pace of employment law developments can be fast and furious at the start of a new year.  Below are a few things you should carefully review.

  • Updated “California Law Prohibits Workplace Discrimination and Harassment” Poster. California’s Civil Rights Department has updated this poster to include information about bereavement and reproductive loss leave and prohibited discrimination based on off-duty cannabis use. Employers must display this poster in a conspicuous place where employees gather. Download the updated poster here.
  • Mandatory Sexual Harassment Training for Janitorial Workers. AB 547 became effective in 2019, requiring janitorial employers to provide in-person sexual harassment prevention training every two years. The COVID-19 public health emergency delayed the implementation of these training requirements. However, effective January 1, 2024, covered employers must begin providing in-person training sessions. Read here for more information.
  • Berkeley’s Fair Workweek Ordinance Guidance. Berkeley’s Fair Workweek Ordinance went into effect January 12, 2024, requiring covered employers to provide written, good faith estimates of work schedules for current employees and applicants and to pay “predictability pay” for schedule changes, among other things. Read the ordinance here, and the related “Frequently Asked Questions” guidance here.

More to come…
