Don’t Forget the DFEH’s Transgender Rights Poster

Effective January 1, 2018, employers must add a new poster to their long list of required ones. The Department of Fair Employment and Housing has created a “Transgender Rights” poster for all employers of 5 or more employees.  The poster, available here, contains definitions of “transgender” and summarizes employers’ obligations.  

The Fair Employment and Housing Act has prohibited discrimination and harassment based on “gender,” and “gender identify” for a long time.  However, the Fair Employment and Housing Commission has recently issued regulations expounding on employers’  obligations with respect to gender identity, expression, etc.  You can find those regulations here. (The modifications are included within the “sex discrimination” regulations.  We wrote an article about those regulations here. However, please note that the article, written in 2016, predated the regulations’ final version.
