With the approval of several COVID-19 vaccines, employers are faced with whether and how to include vaccinations in their COVID-19 protocols. Although the California Department of Fair Employment and Housing issued guidance in March 2021 stating that vaccination programs are lawful in appropriate circumstances, there are many reasons not to require employees to obtain vaccinations. In considering whether to implement a voluntary or mandatory vaccination program, employers should carefully consider a number of issues, including:

• How to handle reasonable accommodation requests
• Document and record retention policies
• How to administer a vaccination program, including wage-hour compliance
• Workers’ compensation risks related to vaccination reactions
• The potential morale and retention challenges created by voluntary and mandatory vaccine program
