  • Reduced Penalties for Proactive Compliance: Employers who take "all reasonable steps" to comply with the law before receiving a PAGA notice can reduce penalties by up to 85%.
  • Enhanced Cure Opportunities: Employers with fewer than 100 employees can submit a confidential proposal to cure alleged violations within 33 days of receiving a PAGA notice, potentially preventing litigation.
  • Increased Employee Share of Penalties: The employee share of recovered penalties has increased from 25% to 35%.
  • More Manageable Claims: Courts now have greater authority to limit the scope of claims and require plaintiffs to have personally experienced the alleged violations.
